Federal Judge Orders Release of Abrego Garcia from ICE Custody

A federal judge has ordered the prompt release of Kilmar Abrego Garcia from detention by ICE, concluding his continued detainment lacks legal authority.

"Since Abrego Garcia's return from wrongful detention in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis stated in her ruling.

The case originates in a mistaken removal to El Salvador in March, which US authorities later admitted was an mistake. Following his return to the United States to face alien smuggling charges, he was held in federal custody.

In her order, the court noted that the authorities does not have a current removal order, which prevents them from deporting Mr. Abrego Garcia "at this time."

Background of the Legal Challenge

The court proceedings center on disputed claims. Whereas the former administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently denies this allegation.

He has also pleaded not guilty to the conspiracy charges, which are part of a separate trial in Tennessee.

The judge, who was overseeing his challenge to removal in a Maryland district court, ruled that he must now comply with the terms of his release from jail in Tennessee. This decision effectively transfers his monitoring to the Tennessee court.
